WHAT MAKES A GOOD (FIRST) PARTY WALL AWARD?

A good Party Wall Award should be comprehensive, clear and fair to both parties involved. 
It should cover all aspects of the work and its potential impact on the adjoining property, ensuring that the adjoining owner, their property and the occupants are well protected without creating undue or excessive burden on the building owner. 

N.B. We speak of 'first awards' because further awards usually determine disputes in relation to loss or damage which means they have a different format and set or requirements.

Here are the key elements that make a good Party Wall Award:

Description of the works

Outline the scope and nature of the proposed works in simple terms. Excessive details are not necessary, particularly where drawings accompany the award.

Include sufficiently detailed drawings to allow the parties to understand the key works but avoid unnecessary drawings and overly technical details such as calculations.

Protection measures

Include measures to protect the adjoining property during the works without being overly prescriptive.
​

Include information on scaffolding, temporary supports, hoarding, roofs,  floors etc.

Access arrangements

Specify what needs protecting and outline the relevant principles to be applied.

Require precautions to be taken that address the security and privacy of adjoining occupants.
Include a practical time limit. ​

Working hours

It is generally best to adhere to local regulations regarding noise and work times as they are easiest to enforce.

Accommodate special requirements without preventing sensible progress to the work.

Dispute Resolution

Outline the process for resolving any disputes that may arise as a result of the work. Ideally include a ‘dispute resolution protocol’.

By ensuring that all of these elements are included and clearly detailed, a Party Wall Award can effectively protect the interests of the adjoining owner, minimise disputes, and allow the project to proceed smoothly.
